Steps to get a Canadian Work Permit in 2023

STEPS TO GET A CANADIAN WORK PERMIT

To work in Canada, you must have a Canadian work permit if you are from outside the nation. However, you may occasionally be able to work in Canada without a permit or job offer, conditions applied.

There are broad eligibility requirements for work permit applications. Regardless of the region for which an application is made, the following factors must be taken into account:

  • When your work permit expires, demonstrate to the officer that you will leave Canada.
  • Demonstrating that you have the resources to support your family while you are in Canada and when you return home.
  • Having a medical checkup if necessary and being in excellent health.
  • Observe the law and don’t have any criminal history (you can be asked to provide a police clearance certificate).
  • Not intend to work for an employer with the classification “ineligible” on the list of employers who did not meet the requirements of being an employer as per law in Canada.
  • Pose no threat to Canada’s security;
  • Not intend to work for a company that regularly provides escort services, sexual dance, striptease, or erotic massages.
  • Any additional documentation the officer requests to show your eligibility for entry should be given.

Stages of Application Development

  • Stage 1: Application for Labour Market Impact Assessment

LMIA, or a labor market impact assessment, is a document that authorities give to employers.

LMIA indicates that the recruitment of an overseas worker is required. Additionally, it will show that no Canadian national or permanent resident meets the requirements for the job. The term “confirmation letter” might refer to a positive LMIA.

Not all employers will need to have an LMIA. It applies only to employers that provide jobs under the LMIA structure. Once the employer gets the LMIA, the worker can apply for a work permit.

A worker must have a contract, a job offer letter, a copy of the LMIA and a LMIA number to apply. Once all the documents are ready, the worker can proceed with the application.

  • Stage 2: Extension of Temporary Job Offer

To extend a temporary job offer, make sure you apply well in advance. Initiate a conversation with your Canadian employer and formalize it by amending the original job offer. The amendment should outline the newly revised terms, such as job description, Requirements for the temporary position, duration of the extension, name, and address of employer, etc.

If your initial job offer required an LMIA, you may need to update it to reflect the extended employment period.

CIC will authorize employment once the Canadian Immigration Department has verified your job offer.

  • Stage 3: Application for Work Permit by foreigners

You may file an application for a temporary work permit in Canada if you have an LMIA and “Job Offer Letter” in order.

You might additionally need to obtain a Certificat d’acceptation du Québec (CAQ) to work temporarily there if the employer recruiting you is based in Quebec. You may be required to attend in person for a visa officer interview while requesting a temporary international working permit.

A Canada Work Permit will be issued if the visa officer is confident that the foreign worker’s employment won’t negatively impact Canadians’ capacity to find jobs in Canada and that the foreign employee is qualified for the position at hand.

  • Stage 4: Issuance of a Work Permit

When the skilled foreign worker enters Canada, a Canada Border Services Agency (CBSA) officer will issue the Canadian Temporary Work Permit. For a foreigner to enter Canada, a Temporary Resident Visa (TRV) can be additionally required, depending on the country of origin of the foreign worker. There are a few more straightforward procedures to go through to obtain a work visa.

Note: You can qualify for two-week application processing if a specific position in your job is at the NOC 0 (managerial, executive) or NOC A (professional) level.

Is it Possible to Obtain Permanent Residency on a Work Visa?

  • If your work permit expires in four months or less and you have applied for permanent residence while working in Canada, you can qualify for a bridging open work permit. This implies that you may continue to work while we decide whether to approve your application for permanent residence. You must have applied to one of the following programs to be eligible:
